La célébration du mariage avec un ressortissant étranger. Le cas des citoyens marocains

Abstract

Le nombre de marriage quand l’un ou les deux contratants sont citoyens marocains a augmenté au cours des dernières années. L’objetif de cette étude était d’analyser les principaux problèmes pratiques identifiès actuellement en ce qui concerne la validité de la célébration du marriage civil ou selon le rite islamique –en Espagne ou en Maroc–, ansi que dans la reconnaissance et l’enregistrement à l’État Civil Espagnol de ces unions qui presentent un caractère d’extranéité.

En los últimos años se ha incrementado el número de matrimonios en España en los que uno o ambos contrayentes son ciudadanos marroquíes. El objetivo de este estudio ha sido analizar las principales dificultades hoy detectadas en la validez del matrimonio celebrado en forma civil o por el rito islámico –en España o en Marruecos–, así como en el reconocimiento y la consiguiente inscripción en el Registro Civil Español de estas uniones con elemento extranjero.

Over the past years the number of one or both prospective spouses are Moroccan citizens has increased in Spain. The aim of this paper is to analyse the main difficulties detected today in order to the validity of the marriage celebrated according to the civil or religious ceremony (Muslim rite) –in both Spain or Morocco–, as well as the legal recognition with the compulsory registration in the Spanish civil Registry.
