abstract = {El objetivo general de este Trabajo de Fin de Grado (en adelante, TFG) es la definición y el estudio de los valores superiores de la Constitución de 1978 a partir de la configuración establecida por la jurisprudencia del Tribunal Constitucional y por la doctrina científica. Partiendo de sus manifestaciones principales en el texto constitucional (artículos 1.1 y 10.1 de la Constitución Española), se observa que la libertad, la igualdad, la justicia, el pluralismo político y la dignidad de la persona son valores superiores que presiden el ordenamiento jurídico patrio. Este TFG, además de la investigación que proporciona sobre la doctrina del Tribunal Constitucional ante dichos valores superiores, analiza de forma sistemática el régimen jurídico y la interpretación acerca de los mismos. Estos valores superiores deben ser considerados como partes integrantes de nuestro ordenamiento jurídico, ya que se tratan de un referente sustancial en los procesos de producción, interpretación y aplicación del Derecho. La Constitución de 1978, en su artículo 1.1, afirma: “España se constituye en un Estado social y democrático de Derecho, que propugna como valores superiores de su ordenamiento jurídico la libertad, la justicia, la igualdad y el pluralismo político”. Según Gregorio Peces-Barba, esos valores se encuentran orientados a la afirmación de la dignidad humana del artículo 10.1 de la CE como base de la paz social y del orden político. Todos estos fines deben ser llevados a cabo de la manera más armónica posible para poder obtener el máximo de cada uno de los valores superiores sin perjudicar a otro más que el mínimo irremediable. En un Estado social y democrático de Derecho, ningún valor puede quedar por detrás de lo permitido para una vida humana digna. Además, en el marco de la constitucionalidad europea, en virtud del artículo 6 del Tratado de la Unión Europea, la Unión reconoce los derechos, libertades y principios enunciados en la Carta de los Derechos Fundamentales de la Unión Europea. Y según el párrafo 6.3 del mismo TUE: “Los derechos fundamentales que garantiza el Convenio Europeo para la Protección de los Derechos Humanos y de las Libertades Fundamentales y los que son fruto de las tradiciones constitucionales comunes a los Estados miembros formarán parte del Derecho de la Unión como principios generales”. Por tanto, entre los principios y valores de nuestro ordenamiento jurídico, se incluyen los referidos por el TUE, la Carta de DDFF de la UE y los relativos a las tradiciones constitucionales comunes. Por último, a partir del análisis de su configuración positiva, jurisprudencial y doctrinal, este TFG realiza una revisión actualizada de la relevancia constitucional de estos valores superiores y de su aplicabilidad a los problemas constitucionales más recientes, concluyendo con que los valores superiores marcan un nuevo rumbo en la historia de la cultura jurídica.},
abstract = {The general objective of this Final Degree Project (hereinafter, TFG) is the definition and study of the superior values of the Constitution of 1978 based on the configuration established by the jurisprudence of the Constitutional Court and by scientific doctrine. Starting from their main manifestations in the constitutional text (Articles 1.1 and 10.1 of the Spanish Constitution), it is observed that freedom, equality, justice, political pluralism and the dignity of the person are higher values that preside over the Spanish legal system. This dissertation, in addition to the research it provides on the position of the Constitutional Court on these higher values, systematically analyzes the positivization and doctrinal creation of these values. These higher values should be considered as integral parts of our legal system, since they are a substantial reference in the processes of production, interpretation and application of law. Article 1.1 of the Constitution states: "Spain is a social and democratic State governed by the rule of law, which upholds freedom, justice, equality and political pluralism as the highest values of its legal system". According to Gregorio Peces-Barba, these values are oriented towards the affirmation of human dignity in Article 10.1 of the EC as the basis of social peace and political order. All these ends must be carried out in the most harmonious way possible in order to obtain the maximum of each of the higher values without harming another more than the irremediable minimum. In a social and democratic state governed by the rule of law, no value may be left behind what is permitted for a dignified human life. Under Article 6 of the Treaty on European Union, resulting from the Treaty of Lisbon, the Union recognizes the rights, freedoms and principles set out in the Charter of Fundamental Rights of the European Union. Moreover, according to paragraph 6.3 of the same TEU: "Fundamental rights guaranteed by the European Convention for the Protection of Human Rights and Fundamental Freedoms and those which result from the constitutional traditions common to the Member States shall form part of the Union's law as general principles". Therefore, the principles and values of our legal system include those referred to by the TEU, the EU Charter of FHRD and those relating to the common constitutional traditions. From the analysis of its positive, jurisprudential and doctrinal configuration, this TFG carries out an updated review of the constitutional relevance of these higher values and their applicability to the most recent constitutional problems, concluding that higher values mark a new course in the history of legal culture.},
