La hipótesis inicial es que en el discurso del fiscal se observará un proceso estratégico de judicialización del relato del testigo, con el fin de guiar sus respuestas y ayudarlo a construir un relato creíble para el jurado, que no se limite a la narración objetiva de los hechos. El objetivo principal es analizar el modo en que el sistema judicial limita la espontaneidad del testimonio y coconstruye una narración adecuada a los requerimientos institucionales. Para ello, se combinará el análisis cualitativo de las preguntas con datos tomados de la herramienta de análisis de corpus Sketch Engine. Los resultados reflejan que, en el contexto de la asimetría de poder existente entre los interlocutores, el lenguaje participa activamente como instrumento de control de las elecciones lingüísticas de la fiscalía al interrogar al testigo, para resaltar la falta de agencia de la víctima y subrayar el entorno opresivo y la violencia extrema de su agresor.; This paper analyzes the discourse of the prosecutor who questioned Tracy Edwards, the victim of an attempted murder perpetrated by Jeffrey Dahmer. The initial hypothesis is that the prosecutor's discourse will reveal a strategic process of judicializing the witness's account, aiming to guide his responses and help him construct a credible narrative for the jury that is not limited to the objective narration of facts. The main objective is to analyze how the judicial system limits the spontaneity of testimony and co-constructs a narrative tailored to institutional requirements. To achieve this, a qualitative analysis of the questions will be combined with data obtained from the corpus analysis tool Sketch Engine. The results show that, within the context of the existing power asymmetry between the interlocutors, language actively acts as an instrument of control over the prosecution's linguistic choices when interrogating the witness, aiming to highlight the victim's lack of agency and to underscore the oppressive environment and the extreme violence of his attacker. La llegada de internet supuso la evolución tecnológica de casi todos los ámbitos de la sociedad, por lo que el arte y los delitos no iban a quedar excluidos. El presente trabajo lanza la interrogante de si las nuevas formas de cometer estafas en el medio digital, así como las nuevas características de las obras de arte, ahora recogidas en NFTs, merecen una mayor atención político criminal o si, por el contrario, se encuentran correctamente abordadas. Para responder a dicha cuestión se ha llevado a cabo una metodología basada en la revisión bibliográfica y normativa de todo aquello referente a los distintos elementos implicados en el fenómeno, como son las obras de arte, los NFTs, el delito de estafa y el medio digital. Entre los principales conclusiones destaca la falta de atención que reciben las estafas mediante obras de arte en el mundo digital, pues ni tan siquiera queda aclarado si el criptoarte puede formar parte de las “obras de arte” desde la perspectiva de su definición histórica y jurídica. Además, este tipo de delito ha evolucionado de tal forma que se ha vuelto un gran problema, pues a pesar de los perjuicios patrimoniales que causa, su persecución mediante la normativa actual es demasiado complicada, generando una situación de impunidad. Si de verdad se desea abordar el problema, será necesaria la implementación de una regulación exhaustiva junto con medidas preventivas.; Art has evolved. The advent of the Internet meant the technological evolution of almost all areas of society, so art and crime were not going to be excluded. This paper raises the question of whether the new ways of committing frauds in the digital environment, as well as the new characteristics of works of art, now included in NFTs, deserve greater criminal policy attention or whether, on the contrary, both are properly addressed. In order to answer this question, a methodology based on a bibliographic and regulatory review of everything related to the different elements involved in the phenomenon, such as works of art, NFTs, the crime of fraud and the digital medium, has been carried out. Among the main conclusions is the lack of attention given to art fraud in the digital world, as it is not even clear whether crypto-art can be part of the “works of art” from the perspective of its historical and legal definition. Moreover, this type of crime has evolved in such a way that it has become a major problem, because despite the financial damage it causes, its prosecution through the current regulations is too complicated, generating a situation of impunity.
