<description>Uniting for Justice: Genocide allegations ICJ case (Ukraine v. Russian Federation)
Nihreieva, Olena
This research is a legal analysis of the recent developments of Allegations of Genocide under the Convention on the Prevention and Punishment of the Crime of Genocide (Ukraine v. Russian Federation) ICJ case. The article focuses on the novelties of the case important for the development of both the procedural and substantive rules of international law. Special attention is paid to the prospects and the results of the litigation taking into consideration a vague competence ratione materiae basis of Ukraine’s claims. Furthermore, the specific issues of a massive intervention of states into the proceedings under Art. 63 of the ICJ Statute are explored. Finally, special emphasis is given to the case role for the consolidation of the obligations erga omnes concept that may potentially help to protect the interests of the international community as a whole.

<title>Establishing the obligations of the occupier concerning the exploitation of natural resources in territories under occupation: Between lex lata and lex ferenda</title>

<description>Establishing the obligations of the occupier concerning the exploitation of natural resources in territories under occupation: Between lex lata and lex ferenda
Nihreieva, Olena
This article examines the legal regulation of the exploitation of natural resources in occupied territories to establish the obligations of the occupier. Consequently, the concept of usufruct as a cornerstone of this legal regime is analyzed considering its historical roots and civil law origins. The application of usufruct is also explored in various domains of international law. Examining usufruct in relation to the principles of the law of occupation clarifies the normative background that defines the obligations of the occupying power. The author concludes that the law of occupation should be updated to address the needs of local populations living under occupation and their right to development.

<title>Protection of the environment under occupation: Scope and content of legal obligations of the occupier</title>
<link>http://hdl.handle.net/10498/40347</link>
<description>Protection of the environment under occupation: Scope and content of legal obligations of the occupier
Nihreieva, Olena
The article is dedicated to the problem of the protection of the environment on occupied&#13;
territories. Due to the fact that the law of occupation doesn’t contain legal rules establishing&#13;
environmental obligations of the occupying power, the environment on the territories under its&#13;
authority often becomes a victim of the overexploitation and destruction. At the same time, it is&#13;
suggested that the current international law, in particular, international human rights law and international&#13;
environmental law, can be used to fill gaps in the rules of international humanitarian&#13;
law. Certainly, the scope and the content of occupier’s obligations will be different depending&#13;
on the instruments applied for the protection of the environment. The author concludes that the&#13;
occupying state may be bound by its own multilateral environmental agreements, multilateral&#13;
environmental agreements of the state which territory is occupied or both groups of treaties. A&#13;
case-by-case approach to environmental human rights protection can serve as a useful tool for&#13;
the concretization of occupier’s environmental obligations.

El informe propone un conjunto de indicadores para medir el sobreturismo y la intensidad turística en ambos municipios, seleccionados por su especial vulnerabilidad a los procesos de turistificación. La información se organiza en tres bloques temáticos, que permiten abordar el fenómeno desde una perspectiva integral (urbana, económica, social y criminológica) en consonancia con el carácter multidisciplinar del proyecto:&#13;
● Bloque 1. Presión urbana. Este bloque analiza cómo la expansión del turismo incide en la organización del espacio construido, en la función residencial y en la convivencia ciudadana. Se centra en los procesos de transformación urbana asociados a la turistificación, con atención a los efectos sobre la vivienda, el uso del suelo y el equilibrio entre actividades residenciales y turísticas.&#13;
● Bloque 2. Economía y empleo. Este bloque aborda el peso del turismo en la economía local y en el mercado de trabajo. Examina cómo la especialización turística condiciona la estructura productiva de los municipios, la calidad y estabilidad del empleo, y las implicaciones sociales que se derivan de la dependencia económica respecto al sector turístico.&#13;
● Bloque 3. Flujos turísticos. Este bloque estudia la magnitud y distribución temporal de los flujos de visitantes. Analiza la concentración de la demanda, la capacidad de absorción de las infraestructuras locales y los riesgos asociados a los picos de presión turística, con el objetivo de valorar la sostenibilidad del modelo en términos urbanos, sociales y ambientales. Se acompaña también de un análisis de la presión turística en términos poblacionales, con objeto de analizar cuánta de comprometida puede verse la capacidad de&#13;
carga de los municipios analizados.&#13;
El enfoque adoptado es exploratorio y diagnóstico.; The report proposes a set of indicators to measure overtourism and tourism intensity in both municipalities, selected due to their particular vulnerability to processes of touristification. The information is organised into three thematic blocks, which make it possible to approach the phenomenon from a comprehensive perspective—urban, economic, social, and criminological—in line with the multidisciplinary nature of the project:&#13;
● Block 1. Urban pressure. This block analyses how the expansion of tourism affects the organisation of the built environment, residential functions, and community coexistence. It focuses on the processes of urban transformation associated with touristification, paying particular attention to its effects on housing, land use, and the balance between residential and tourist activities.&#13;
● Block 2. Economy and employment. This block examines the role of tourism in the local economy and labour market. It explores how tourism specialisation shapes the productive structure of the municipalities, the quality and stability of employment, and the social implications arising from economic dependence on the tourism sector.&#13;
● Block 3. Tourist flows. This block examines the scale and temporal distribution of visitor flows. It analyses the concentration of demand, the capacity of local infrastructure to absorb visitor numbers, and the risks associated with peaks in tourism pressure, with the aim of assessing the sustainability of the model in urban, social, and environmental terms.&#13;
The report also includes an analysis of tourism pressure in population terms, with the aim of assessing the extent to which the carrying capacity of the municipalities under study may be compromised.&#13;
The approach adopted is exploratory and diagnostic.
