Orígenes europeos de las Declaraciones de Derechos Humanos en los Reinos hispano medievales

Abstract

En el presente trabajo empezaremos estableciendo un acercamiento breve al concepto de “Derechos Humanos”, seguido de una explicación acerca de la evolución histórica de los mismos en sus formulaciones a lo largo de los últimos siglos.

Asimismo, y tras contextualizar brevemente la época que se tratará, expondremos las distintas fuentes del Derecho medieval sobre Derechos Humanos en los Reinos de la Península Ibérica, con algún apunte de Declaraciones de derechos medievales europeos. Luego explicaremos las manifestaciones de Derechos Humanos más destacados que tuvieron su nacimiento en el sistema jurídico medieval. Finalmente, concluiremos el trabajo haciendo hincapié en la importancia que tuvo España en este sistema jurídico a la hora de formular los primeros cimientos de lo que siglos más tarde llegarían a ser los Derechos Humanos.

In the present work we will begin by establishing an approach to the concept of "human rights", followed by a brief explanation about the historical evolution of the same in their formulations over the last centuries.

Also, after briefly contextualizing the time to be discussed, we will expose the different sources of medieval law on Human Rights in the Kingdoms of the Iberian Peninsula, with some notes of European Medieval Rights Declarations. We will then explain the most prominent manifestations of human rights that were born in the medieval legal system. Finally, we will conclude the work by emphasizing the importance that Spain had in this legal system in formulating the first foundations of what would later become human rights.
