Análisis de la Propuesta de Modificación Legal de la Zona Federal Marítimo Terrestre de México

Abstract

En este artículo se utiliza el análisis comparativo para la propuesta de modificación legal de la franja costera llamada zona federal marítimo terrestre (Zofemat) en las costas de México. Se establecen y analizan los antecedentes y contexto de la Ley General de Bienes Nacionales y todo el marco jurídico vigente de la Zofemat. Se discuten las razones por las que no debe ser modificada la Zofemat por una franja de observancia del estado de derecho más angosta y se concluye que con esa modificación se pierde el beneficio que hace la coordinación en el manejo integrado costero de la Zofemat actual y que lo único que se requiere es recursos financieros para la aplicación de la ley para hacerla valer en bien de la sociedad y del ambiente costero

In this paper we use a comparative analysis for the legal modification proposal of the coastal strip called maritime terrestrial federal zone (Zofemat) of Mexico. We established and analyzed the background and context of the General Law of National Goods and all the current legal framework of the Zofemat. We discussed the main reasons for which should not be modified the width of the Zofemat that modifies the law implementation; and we concluded that with the proposed modification it is lost the benefit of implementing the coordination in the integrated coastal zone management of the Zofemat for the society and the natural coastal environment.
