Análisis del régimen constitucional de los Estados Unidos de América

Abstract

Los Estados Unidos de América llevan siendo regidos jurídicamente desde el año 1787 por la misma Constitución, lo que ha consolidado un proceso estatal con más de 235 años de historia bajo una misma norma fundamental. Mientras que la mayoría de Estados han evolucionado conforme a una historia constitucional articulada a partir de varios textos constitucionales (España, Francia, Alemania, Italia…), los Estados Unidos han sido capaces de mantener durante tanto tiempo los valores y principios constitucionales defendidos por los Padres Fundadores. Conforme a una metodología histórico-jurídica que emplea fuentes positivas, jurisprudenciales y doctrinales, en este Trabajo Fin de Grado se analiza cómo ha sido la historia constitucional de esta nación durante estos dos siglos y, en particular, conocer y entender mejor dos de sus instituciones más importantes: la Presidencia de los Estados Unidos y el Federalismo estadounidense.

The United States of America have been ruled legally since the year 1787 by the same Constitution, what has consolidated a state process with more than 235 years under the same fundamental rule. While the majority of States have evolved according to a constitutional history articulated from several constitutional (Spain, France, Germany, Italy…), the United States have been capable of maintain for so long the constitutional values and principles defended by the Founding Fathers. According to a historical-legal methodology that employs positive, jurisprudential and doctrinal sources, in this Final Degree Project we analyse how has been the constitutional history of this nation during this two centuries and, in particular, to know and understand in a better way two of their more important institutions: the Presidency of the United States and the American Federalism.
