Abstract

The application of national procedural rules to the request to waive the immunity of Members of the European Parliament generates problems of different depths arising from the lack of Community regulation of the immunity of its members and the referral to different regimes depending on the Member State in which the legal proceedings are conducted. It is not easy to apply immunity to national MEPs in the same terms as to MPs and Senators when the CJEU interprets the institution differently from our courts, which obliges us to carry out a study that addresses these differences, while redefining the insti-tution in the current procedural context governed by pre-constitutional rules that do not take into account the basis and purpose of immunity or of the request for judicial review.
