Abstract

This work deals with the uncertainty generated in terms of extra-contractual civil liability for damages caused by AI systems. As a result of the new Proposal for a Directive on adapting non-contractual civil liability rules to artificial intelligence and Proposal for a Directive on liability for defective products presented in september 2022, new problems have been generated as a result of the attribution of liability, and to which subjects it is attributed. The dichotomy between liability for risk or for fault is a matter of discussion, and the Proposal for a directive on AI in particular, favors liability for fault taking into account the difficulties of proof.
