Abstract
The United Kingdom started its counterterrorism policies decades before 9/11 attacks. That, amongst other causes, explains its influence on the counterterrorism European legislation. The legislation on the topic has experienced some changes during last years, due to several terrorist attacks in British territories and the prospect of a Brexit deal. Those changes follow classic trends on British counterterrorism but at the same time face directly the European Convention on Human Rights, especially its article 7. This paper makes a complete analysis on the British fight against terrorism, remarking the incidence on the European criminal policy, some judgements about counterterrorism legislation of the European Court of Human Rights vs. United Kingdom, a brief comparison with Spanish law, and the most recent legal texts of the post-Brexit era.
