Abstract

Almost a century after the signing of the Slavery Convention in 1926, the Spanish penal system fails to criminalise the imposition of forced labour, servitude, slavery, or similar practices, as required by international law. In November 2022, the Council of Ministers approved a Draft Comprehensive Organic Law against Trafficking and Exploitation of Human Beings, which fulfils the commitment of the Spanish Código Penal to autonomously criminalise these acts. To achieve this goal, the Draft proposes a comprehensive reform of the Código Penal. This includes technical improvements to Article 177 bis (trafficking in human beings), as well as the introduction of new crimes related to forced labour, servitude, and slavery in Article 177 ter. Furthermore, the use of services, benefits or activities of the victims will be criminalised under Article 177 quarter. The reform aims to be a turning point in the way these behaviours are dealt with. However, the innovative offenses are more restrictive than required under International and European law. Additionally, the non- inclusion of generic labour exploitation among the purposes of trafficking in human beings suggests a purely symbolic protection, which may be inefficient in protecting important human rights linked to decent work.
