Medio siglo de Constitución en Quintana Roo, México. Evolución de los elementos de población y territorio en su articulado

Abstract

Tras medio siglo transcurrido desde la promulgación de la Constitución Política del Estado Libre y Soberano de Quintana Roo, es un buen momento para hacer balance sobre los aciertos y desaciertos cometidos para regular dos elementos básicos de toda entidad, como lo son el territorio y la población. Por medio de trabajo de gabinete y un método cualitativo, en el presente artículo se realiza un análisis del contenido de los Títulos Tercero y Cuarto del texto constitucional local quintanarroense, junto con las reformas que han experimentado y una declaración de invalidez emitida por la Suprema Corte de Justicia de la Nación. El resultado debe ser de interés de estudios del constitucionalismo de la entidad caribeña, la cual aún tendrá que seguir enfrentando desafíos para terminar de definir sus límites territoriales y así dar por terminadas las controversias constitucionales suscitadas al respecto

After half a century since the promulgation of the Political Constitution of the Free and Sovereign State of Quintana Roo, it is a good time to take stock of the successes and failures committed to regulate two basic elements of any entity, such as the territory and the population. Through cabinet work and a qualitative method, the present article analyzes the content of Titles Three and Four of the local constitutional text of Quintana Roo, along with the reforms they have undergone and a declaration of invalidity issued by the Supreme Court of Justice of the Nation. The result should be of interest to studies of the constitutionalism of the Caribbean entity, which will still have to face challenges to finish defining its territorial limits and thus put an end to the constitutional controversies that have arisen in this regard
