143 CP. Organic Law 3/2021 of 24 March on the Regulation of Euthanasia (LORE), in
force since 25 June 2021, recognises for the first time in Spain the right of individuals meeting certain requirements to request and receive assistance in dying. The first final provision
of this law introduces a new subsection (5) to Section 143 of the Spanish Criminal Code,
establishing that no criminal liability shall be incurred by any person who causes or actively
cooperates in the death of another, provided such actions are carried out in strict compliance
with the provisions of the LORE. This paper draws on the interpretation of the fundamental
right to life enshrined in Section 15 of the Spanish Constitution, as articulated in Constitutional Court Judgments 19/2023 of 22 March and 94/2023 of 12 September. Adhering to
the complex regulatory framework laid down in the LORE regarding the right to request and
receive assistance in dying, the analysis focuses on the legal nature and conditions for the
application of the provision set out in Section 143.5 of the Spanish Criminal Code.
