Abstract

The prominence assumed by violence, intimidation, and other means in the debates surrounding the reforms of sexual offences enacted by Organic Laws 10/2022 and 4/2023 necessitates an approach to the role that means of committing offence play in each of the proposed classification systems. Each of these has revealed the different significance that such behaviours hold in the configuration of the offences of sexual assault and rape, assigning them a distinct foundation that directly impacts the wrongful act by altering the normative relations and the limits of concurrence between the applicable provisions. Conditioned by what is conceived as medial or instrumental, the reinstatement of violence, intimidation, or other new forms of influence following Organic Law 4/2023 has revived old debates about the concept and function that such behaviours play in sexual offences. In particular, this discussion will address the concept of instrumental violence, the relationship between intimidation and the offence of threats, or the delimitation of influence when the victim's will is nullified for any reason.
