dc.description.abstractLa evolución de la política criminal española sobre maltrato animal ha estado marcada desde sus inicios por dos cuestiones controvertidas: la concreción de qué es lo que hay que proteger a través de los delitos relacionados con el maltrato y abandono de animales, y cómo hay que protegerlo. Las respuestas dadas estas cuestiones se han venido plasmando en las sucesivas modificaciones que ha experimentado hasta el momento la regulación de estos comportamientos en nuestro país. A principios de 2023 el legislador español ha marcado un nuevo hito en la política criminal sobre maltrato animal, en el que se evidencian las presiones que ejercen los diferentes grupos de interés en la política desarrollada sobre esta materia. El resultado de esta nueva reforma penal probablemente satisfará a muy pocos de los partidarios de ampliar la tutela otorgada a los animales, pues no parece coherente ni con la teoría del “bienestar animal”, ni con la tesis de los “derechos de los animales”.es_ES
dc.description.abstractThe evolution of Spanish criminal policy regarding animal abuse has been marked, since its inception, by two controversial issues: determining what should be protected through crimes related to the abuse and abandonment of animals, and how to provide that protection. The responses to these questions have been manifested in the successive modifications that the regulation of these behaviours has undergone in our country. In early 2023, the Spanish legislature reached a new milestone in the criminal policy concerning animal abuse, highlighting the pressures exerted by various interest groups on the policies developed in this field. The outcome of this new penal reform is likely to satisfy very few of those advocating for an expansion of the protection granted to animals, as it does not appear to align with either the theory of "animal welfare" or the "animal rights" thesis.es_ES
