Protección penal contra la aporofobia en el marco de la Agenda 2030 para el Desarrollo Sostenible: un paralelo entre la realidad española y brasileña

Abstract

El presente trabajo de investigación, a partir del estudio bibliográfico y de la estrategia metodológica cualitativa, pretende una reflexión sobre la necesidad de protección penal contra la aporofobia, estableciendo un paralelo entre la realidad española y brasileña en el marco de la Agenda 2030 para el Desarrollo Sostenible. En este sentido, se profundiza en torno del concepto de aporofobia y su comprensión a la luz de la tutela constitucional de los colectivos vulnerables y de la dignidad de la persona, reflexionando sobre el marco normativo de la aporofobia en España, sobre la situación en Brasil y la importancia de la participación popular en el debate sobre el tema. La promoción de sociedades inclusivas, con la facilitación del acceso a la justicia para todos, es también un hilo conductor de este estudio

This research, based on the bibliographic study and the qualitative methodological strategy, aims to reflect on the importance of criminal protection against aporophobia, establishing a parallel between the Spanish and Brazilian reality in the context of the 2030 Agenda for Sustainable Development. For this, it deepens around the concept of aporophobia and its understanding in light of the constitutional protection of vulnerable groups and the dignity of the person, reflecting on the regulation on aporophobia in Spain, on the situation in Brazil and the necessity of popular participation in the debate on the matter. The promotion of inclusive societies, with the facilitation of access to justice for all, is also a common thread of this study.
