Libertad, responsabilidad y derechos fundamentales desde el determinismo causal

Abstract

El determinismo causal y los descubrimientos neurocientíficos que parecen confirmarlo no anulan la libertad ni la responsabilidad moral y jurídica, sino que solo refutan el libre albedrío metafísico, entendido como voluntad sin causa, como voluntad como única causa de la conducta, o como poder hacer algo diferente de lo que se hizo si volvieran a darse las mismas circunstancias. El libre albedrío metafísico es una ensoñación sin base científica alguna. En su lugar se mantiene una concepción no metafísica de la libertad, que sustenta tanto la responsabilidad como los derechos fundamentales en una sociedad democrática.

Causal determinism and the neuroscientific discoveries that seem to confirm it do not abolish freedom or moral and legal responsibility, but only refute metaphysical free will, understood as uncaused will, as will as the only cause of behaviour, or as the possibility of doing something different from what was done if the same circumstances were to occur again. Metaphysical free will is a fantasy without any scientific basis. In its place is a non-metaphysical conception of freedom, which underpins both responsibility and fundamental rights in a democratic society.
